MOBERLY, MO – A Moberly man is accused of a class A felony for assault in the first degree.
Moberly Police made the arrest upon investigation of events July 8 involving Jerry L. Fitzwater, accused of shooting a person in the head with a .22 caliber firearm, armed criminal action, and unlawful weapons use.
According to court documents, Fitzwater claimed residents of a property he owns allegedly sold drugs regularly to children. In statements to police Fitzwater admitted to shooting the victim and said, he had “had enough,” and was taking matters into his own hands. He also indicated in the statement, he might have shot more of them if police had not arrived so quickly.
At arraignment Monday the judge in the case recused himself. That matter, as well as a bond review, are scheduled for a continuance July 21.
